

Enforcement Resolution
There are occasions where you may find yourself on the wrong side of your local Council.

Local Councils and private building surveyors alike, are tasked with ensuring building standards are maintained in Victoria. Our role is to ensure that buildings are constructed correctly, with the appropriate approvals in place.
​
If it is suspected that you have completed building works without appropriate approvals, or have completed works incorrectly, enforcement proceedings may be commenced under the Building Act 1993 against you. This process ordinarily starts with the issue of a Building Notice, which could progress to a Building Order or even court proceedings.

This can be very daunting if you are unfamiliar with what this means.

If you find yourself if this situation it is crucial not to simply ignore it, as it will NOT just go away (every building notice or building order will be attached to your property indefinitely and will show up on information requests from Council for 10 years)

Next Project Building Permits can liaise with local Council and assist with resolving the issue (there is even the possibility you may be able to retain the structure) but it is important to reach out EARLY.​
